Graphit provides a cloud-based metrics tracking and analytics platform designed for churches and religious organizations. The Service includes:

• Multi-campus and multi-user support

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

The Service and its original content, features, and functionality are owned by Graphit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the data and content you upload to the Service ("Your Content"). By uploading Your Content, you grant us a limited license to:

• Store, process, and display Your Content as necessary to provide the Service
• Create backups and ensure data security
• Use aggregated, anonymized data for analytics and improvements

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without compensation or attribution.

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

Some jurisdictions do not allow limitations on warranties or liability, so these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Graphit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded to the Service

The Service may integrate with or link to third-party services (e.g., Stripe for payments, AWS for hosting). We are not responsible for:

• The availability or accuracy of third-party services
• The content, privacy policies, or practices of third parties
• Any damage or loss caused by third-party services

Your use of third-party services is governed by their respective terms and policies.

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending an email notification to your registered email address

Your continued use of the Service after changes constitutes acceptance of the modified Terms.

13.1 Termination by You

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Graphit regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights without restriction.

15.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control.
